Terms and Conditions

These Terms explain how we work at ReadySetSites LLC (“ReadySetSites,” “we,” “our”). Any Proposal you sign works together with these Terms to form our full agreement.

1. Agreeing to These Terms

By using our website or services, you’re agreeing to these Terms. If you have any concerns about them, just reach out and we’ll be happy to help clarify anything.

2. Accounts

Some services require an account. You’re responsible for keeping your login info safe and for the activity on your account. Please make sure the info you provide is accurate and up to date.

3. Payments and Billing

One-Time Work

Invoices for project work or billable hours are due upon issuance. Since this work reflects time already invested, refunds cannot be provided for hours that have been completed.

Automatic Subscriptions

Subscriptions renew automatically unless you cancel with 30 days’ notice through a support ticket in the ReadySetSites Dashboard.

Offline/Manual Payments

If you pay by check, ACH, or other offline methods, payment is due within 15 days unless we’ve agreed otherwise.

Invoices & Late Fees

All invoices are due within 15 days. Past-due accounts receive a 2% monthly late fee.

4. Ownership of Your Website

All work we create – designs, code, layouts, configurations – belongs to us until the project is fully paid for.

Once everything is paid in full:

  • You own the final website
  • You own all content you provided to us (logos, photos, text, etc.)
  • Third-party themes or plugins stay under their original licenses
  • Drafts, templates, and internal tools we use to build your site stay ours

Hosting does not give ownership of servers or infrastructure.

5. Website Projects: Scope, Revisions, and Changes

Scope of Work

Your signed Proposal is the single source of truth for what’s included. If it’s not in the Proposal, it’s not part of the project.

Changes & Add-Ons

If you need changes or new features after the scope is set, we’re happy to help – those items are billed separately unless the Proposal says otherwise.

Revisions

Every project includes a set number of revision rounds, explained in the Proposal. Extra revisions or redesigns are billable.

What We Need From You

To keep your project moving smoothly, we need timely feedback, approvals, content, and access.
A typical timeframe for replies is 7–14 days.
You’ll also need to provide rights to any content you give us.

Abandoned Projects

If we don’t hear from you or can’t continue the project for 30 days due to missing content or lack of communication, we may pause the project.
We’ll send at least one follow-up email before doing so.
Restarting may require a fee.

Delays

If the timeline stretches because we’re waiting on content, approvals, logins, or anything else from you, that’s completely okay—just understand the project timeline will shift accordingly.

6. Canceling a Project Early

If you decide to end the project early, you’ll be invoiced for all work completed up to that point.
There is also a 20% cancellation fee on the remaining project balance to cover the time we’ve reserved for you.

7. Non-Payment and Website Suspension

If payment falls behind, we may suspend hosting or access to the website.
We may also place a temporary placeholder page until the account is current.

Reactivating service within 30 days includes a $150 reactivation fee.

If the account has been overdue for more than 30 days, we may permanently remove hosted files or backups.
Please make sure you’ve saved anything you need—ReadySetSites is not responsible for data lost due to non-payment.

8. Backups & Warranty

Backups

We keep daily backups for 30 days, but we can’t guarantee restoration in every case. It’s always a good idea to keep your own copies of important content.

Warranty After Launch

We offer a 14-day bug-fix window for any issues directly related to our work.
The warranty doesn’t cover:

  • New features
  • Changes to hosting or DNS
  • Plugin or theme updates
  • Issues caused by edits you or another developer makes

We’re always happy to help with those items – they just fall under billable support.

9. Service Availability

We do our best to provide reliable service, but we can’t guarantee perfect uptime.
We aren’t responsible for outages caused by:

  • Hosting providers
  • Domain registrars
  • DNS issues
  • Plugin/theme vendor issues
  • Power outages or disasters
  • Cyberattacks
  • Acts outside our control

These types of events are considered “force majeure.”

10. Third-Party Tools & Providers

We use various third-party tools, plugins, and services.
If one becomes deprecated, insecure, or unavailable, we may replace it or remove it.
Work required because of a third-party issue is billable.

11. Security & Access

Please use strong passwords and enable two-factor authentication when possible.
We may limit access if we believe an account is compromised.

12. Secondary Contact

You may list a secondary contact for billing or account issues. If we can’t reach the primary contact, we’ll reach out to the secondary.

13. HIPAA, ADA, and Industry Compliance

ReadySetSites is not a HIPAA-covered entity, and our services don’t guarantee HIPAA, ADA, WCAG, PCI, or other compliance unless we have a separate written agreement stating otherwise.

Please do not store or send Protected Health Information (PHI) through your website or our services unless we’ve signed a Business Associate Agreement (BAA) with you.

You’re responsible for meeting any legal or regulatory requirements that apply to your business.

14. Copyright & DMCA

If you upload or provide copyrighted content, you must have permission to use it.
Repeat violations may result in suspension.

DMCA notices can be sent to it+dmca@readysetsites.com. We process these as a service provider, not as legal counsel.

15. SEO & Marketing Expectations

While we follow industry best practices, we cannot guarantee specific performance results, including:

  • Search engine rankings
  • Increases in site traffic
  • Leads, sales, or conversion rates

These outcomes depend on many variables outside of our control.

16. Limitation of Liability

To the fullest extent allowed by law, ReadySetSites is not responsible for:

  • Lost profits, revenue, or business
  • Lost data
  • Third-party failures or downtime
  • Any indirect or consequential damages

If a court ever finds us responsible for something, our maximum liability is limited to the total amount you paid us in the previous 3 months.

17. Services Provided “As-Is”

We work hard to provide high-quality services, but we can’t promise everything will always be perfect. All services are provided “as is.”

18. Indemnification

You agree to protect ReadySetSites from claims related to:

  • Content you provide
  • Legal compliance issues
  • Misuse of your website
  • Security issues caused by your actions

We’re responsible for issues that arise only from intentional wrongdoing on our part.

19. Confidentiality

We’ll keep any sensitive information you share with us private, and we expect the same in return.

20. Feedback & Testimonials

If you share feedback or a testimonial, you allow us to use it for marketing unless you ask us not to.

21. Promotions

Any promotions or contests we run will include separate details and rules.

22. Updates to These Terms

We may update these Terms occasionally. If you continue using our services after we post updates, that means you accept the new Terms.

23. Nebraska Law

These Terms are governed by Nebraska law. Any disputes will be handled in Sarpy County, Nebraska.

24. Entire Agreement

The signed Proposal and these Terms together form the entire agreement between you and ReadySetSites. Anything we talked about before the Proposal – emails, conversations, ideas – is not part of the agreement unless written into the Proposal.
