Acceptance of Terms

By accessing or using our website at https://readysetsites.com (the “Website”) and our services, You (“Users”, “Customer”) agree to comply with and be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, please do not use our services.

Account Registration

You are responsible for maintaining the confidentiality of your account information and for all activity that occurs under your account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

DMCA Compliance

ReadySetSites respects the intellectual property rights of others. If you believe that any content on our Website infringes your copyright, please send a DMCA notice to our designated agent at it+dmca@readysetsites.com, including the information specified in our DMCA policy.

Prohibition of Copyrighted Material

Users are prohibited from uploading, publishing, or sharing any material that infringes upon the copyrights or intellectual property rights of others without proper authorization. ReadySetSites reserves the right to remove any content that violates copyright laws and to terminate access to services for users who repeatedly engage in copyright infringement.

Payments and Refunds

a. Goods, Items, and Services: Users agree to pay for goods, items, and services provided by ReadySetSites. Payment for one-time fees is due upon the purchase of such goods, items, or services. We do not offer refunds for billable hours or invoiced time spent on services provided to our clients.

b. Automatic Subscription Plans: Users who subscribe to our recurring services on a subscription basis agree to pay the applicable fees as specified on the Website. Subscriptions renew automatically until canceled. To cancel a subscription, 30 days’ notice is required. Cancellation notices may be submitted by opening a ticket in the ReadySetSites Dashboard (use “Cancellation of Services” as the topic).

c. Manual Subscription Plans: Users opting for our recurring services and choosing to pay via check, money order, ACH, or any other acceptable non-automated payment method will receive notifications through the email address provided by the user. Users are required to remit payment within 15 days of the renewal date unless an alternative arrangement has been agreed upon.

d. Invoices: Users agree to pay all invoices issued by ReadySetSites within 14 days of receipt, unless another agreement is made in writing.

e. Late Fees: Past-due invoices and plans are subject to a late fee of 2% per month on the outstanding balance.

Termination due to Non-Payment

ReadySetSites reserves the right to terminate or suspend services in the event of non-payment of fees or charges. Termination will result in the removal of access to the services and any associated data. Users are responsible for any outstanding fees upon termination.

If a website or service is terminated due to non-payment, a reactivation fee of $150 will be charged to reinstate services. This fee covers the administrative costs associated with reactivating the account and restoring access to the website or service. Please note that in most cases, services can only be restored within 30 days of termination.

Price Adjustments

ReadySetSites may adjust the prices for its goods, items, and services at its discretion. Notice of price adjustments will be provided on the Website, and changes will take effect upon the next billing cycle for subscription services.

Third-Party Software and Providers

During the construction of the website, ReadySetSites may utilize third-party software and providers such as themes, plugins, security programs, hosting providers, and more. It’s important to note that these third-party services are subject to change, and there’s a possibility that they may discontinue their services or updates.

In the event of such occurrences, ReadySetSites reserves the right to take necessary actions to ensure the continued functionality and security of your website. This may involve migrating the website to an alternative service or integrating alternative software solutions. Please be aware that addressing these scenarios may require additional time and resources beyond the original scope of the project.

As part of our commitment to transparency, we want to keep you informed about any significant developments related to third-party software and providers used in the website development process. Rest assured, we will communicate openly about any changes or actions taken to address potential issues arising from discontinued services or updates.

By engaging the services of ReadySetSites, Users acknowledge and agree to the potential implications outlined herein regarding the utilization of third-party software and providers. Please understand that any additional work required to address these scenarios will be considered billable time, subject to our standard hourly rate.

Password Security and Access Management

Users are responsible for using strong passwords and, if applicable, two-factor authentication (2FA) to secure their accounts and the backend of their websites. ReadySetSites reserves the right to remove access to protect the website in the event of inadequate password security.

Secondary Contact for Accounts

In the event of payment failure or the inability to contact the primary account owner for any reason, ReadySetSites may need to reach out to a designated Secondary Contact for resolution. The Secondary Contact is an individual authorized by the primary account owner to manage billing-related issues and communication on their behalf.

By providing the details of a Secondary Contact, the primary account owner acknowledges and agrees to the following:

  1. Authorization:
    • The primary account owner authorizes the Secondary Contact to act on their behalf in matters related to billing, communication, and account management.
  2. Contact Information:
    • The primary account owner must provide accurate and up-to-date contact information for the designated Secondary Contact. This information should include:
      • Full Name
      • Email Address
      • Phone Number
  3. Responsibilities of the Secondary Contact:
    • The Secondary Contact agrees to:
      • Receive communications from ReadySetSites regarding billing matters.
      • Provide necessary information or take appropriate actions to resolve payment issues.
  4. Notification to Primary Account Owner:
    • ReadySetSites will make reasonable efforts to notify the primary account owner in the event of a payment failure or communication issue. However, if the primary account owner cannot be reached within a specified period, ReadySetSites reserves the right to contact and work with the Secondary Contact.
  5. Changes to Secondary Contact Information:
    • The primary account owner is responsible for promptly updating the Secondary Contact information if there are any changes. This can be done through the account settings or by contacting ReadySetSites support.
  6. Termination of Secondary Contact Authorization:
    • The primary account owner has the right to revoke the authorization of the Secondary Contact at any time by updating the account settings. ReadySetSites will act upon the latest information provided by the primary account owner.
  7. Liability:
    • The primary account owner understands and accepts that any actions taken by the Secondary Contact on their behalf are the responsibility of the primary account owner.

Data Backup and Warranty

ReadySetSites takes daily backups of website data and retains them for 30 days outside of the server environment, unless another agreement is made. However, we cannot guarantee the absence of data loss. Users are encouraged to maintain their own backups and data security measures.

Users may request periodic backups of their website data from ReadySetSites if they wish to maintain their own copies. Requests for backups can be made by contacting our support team through the ReadySetSites Dashboard.

User Feedback

Users who provide feedback to ReadySetSites acknowledge and agree that we may use such feedback for any purpose, without providing compensation or credits.

Promotions, Contests, and Sweepstakes

From time to time, ReadySetSites may offer promotions, contests, or sweepstakes. Additional terms and conditions may apply, and participation in these activities is subject to those terms.
